"Spikes" - in the form of an equilateral triangle of white color with the top up with a red border, into which the letter "SH" is inscribed in black (the side of the triangle is not less than 200 mm, the width of the border is 1/10 of the side) - behind motor vehicles with studded tires;

In general, such a measure is aimed at warning drivers moving behind cars so that they can increase the distance to the car in front of them in order to avoid collision with it in case of emergency braking. By the way, if you don’t have this sign, then you won’t get anything for it - at least there shouldn’t be anything according to the law, since sanctions for the absence of the Spikes sign on the car are simply not provided for by the Code of Administrative Offenses according to the data relevant, including for 2020 - no "November innovations" and no new changes in laws were made during the year. Nevertheless, traffic police officers continue and continue to fine legally illiterate drivers for this sign.

But how do they fine for this, if no sanctions are provided - after all, the decree must indicate an article, which, by the way, determines, among other things, the amount of the fine for the absence of the "Ships" sign ?! It's simple - the inspectors successfully replace another article, passing it off as desirable and legitimate. Let's take a closer look - there is such an article in the Code of Administrative Offenses under the number 12.5, paragraph 1 of which tells us the following:

Article 12.5. Driving a vehicle in the presence of malfunctions or conditions under which the operation of vehicles is prohibited.

1. Driving a vehicle in the presence of malfunctions or conditions under which, in accordance with the Basic Provisions for the admission of vehicles to operation and the duties of officials to ensure road safety, the operation of the vehicle is prohibited, with the exception of malfunctions and conditions specified in parts 2 to 7 of this Article - shall entail a warning or the imposition of an administrative fine in the amount of five hundred roubles.

We now know what penalty is imposed under what circumstances. Meanwhile, the section of the Rules, where it is indicated about the sign "Spikes", is called " Basic provisions for the admission of vehicles to operation and the obligations of officials to ensure road safety".

But in the traffic rules there is another note, which is called " Application. List of malfunctions and conditions under which the operation of vehicles is prohibited". And, if you carefully read the last three paragraphs, then you probably understood what the catch is here and why you cannot be fined for the absence of the "Thorns" sign.

Let us explain: article 12.5 and its first part refer in their direct text to Note to the Rules of the Road, and therefore applies exclusively to violations of those paragraphs of the traffic rules that are indicated in this Note - in particular, there is a prohibition on driving in the event of a faulty
